二、CMR公約下，承運(yùn)人的責(zé)任（考試重點(diǎn)）
在CMR公約下，承運(yùn)人將對下列情況負(fù)責(zé)：
1.The acts and omissions of his agents and servants or other persons whose services he makes use； 承運(yùn)人的代理人，受雇人或其他人的作為和不作為。
注釋：act： 行為，舉動，作為 omission： 疏忽； 失職， 懈怠；不作為 servant： 受雇人
2.Loss of or damage to the goods occurring between the time he takes over the goods and the time of delivery as well as for any delay in delivery.
自他接管貨物到交付期間發(fā)生的滅失和損害和延遲交付。
注釋：loss： 損失 damage： 損壞，破壞 occur： 發(fā)生，出現(xiàn) take over：接受，接管 delay in delivery ： 延遲交付
三、CMR 公約下，承運(yùn)人的免責(zé) （考試重點(diǎn)）
在下列情況下，承運(yùn)人對貨物的滅失，損害和延遲交付免除責(zé)任：
1. Any wrongful act or neglect of the consignor. 由于發(fā)貨人的錯誤行為或者過失造成的貨物的滅失，損害和延遲交付，承運(yùn)人不承擔(dān)責(zé)任。
注釋：wrongful： 不正當(dāng)?shù)�，錯誤的 neglect： 疏忽，忽視，過失 consignor： 發(fā)貨人，委托人
2.Inherent vice of the goods； 貨物的固有缺陷
注釋：inherent vice： 固有缺陷，內(nèi)在缺陷 （inherent：固有的，內(nèi)在的 vice： 缺點(diǎn)，缺陷）
3.Circumstances which he could not avoid and the consequence of which he was unable to prevent. 承運(yùn)人無法避免的情況以及無法預(yù)防的結(jié)果。
注釋：circumstance： 情況，形勢 avoid： 避免 consequence： 后果，結(jié)果 be unable to： 不能，沒有能力…… prevent： 防止，預(yù)防
但是承運(yùn)人在此情況下不能免責(zé)：
The carrier shall not be relieved of liability of reason of the defective condition of the vehicle used by him in order to perform the carriage， or by reason of the wrongful act or neglect of the person from whom he may have hired the vehicle or of the agents or servants of the latter.
對于由于為履行運(yùn)輸而使用之車輛的不良狀態(tài)或由于承運(yùn)人已租用其車輛的人的或他的代理人或他的受雇人的錯誤行為或過失，承運(yùn)人不應(yīng)免責(zé)。
